How do my wife and I get a no fault divorce in NYS?

by Bob on September 8, 2010

My wife and I have finally made the decision to get a divorce. We have a young son, a house, cars, animals… For the most part we know how we want to handle everything, but do not know where to begin with the legal part. If anyone can offer assistance we would greatly appreciate it.

Go to the library and ask the librarian to show you where that section is. The library has books that you simply photo copy out the pages and hand write in everything. Then you and your wife sign it in front of a notary and then you go to the court house and you pay and file the papers. There will be a court date set and you both show up and the judge will grant you your divorce.

My neighbors did it and i helped, so that’s how i know to go to the library. It’s asked for all the time so it’s not embarrassing, so don’t worry about it. Oh, and make certain you bring a couple of bucks for the copy fees. Well, down here it was 7 cents a copy page, don’t know what NY prices are… might be much higher. Best of luck.

If you are both in agreement about the divorce and how to divide assets, child support, child visitation, etc. Contact a local attorney, I know people that have had mutual divorces and it only cost them about $500 for the attorney to draw up the paperwork and file it with the court. It saves you time and it’s easy (easy IF both are in agreement; otherwise then it gets very complicated).
